Acceptance of Terms
1.1 By accessing or using the Web App, you represent that you have read, understood, and agree to be bound by this Agreement.
1.2 If you do not agree to any provision of this Agreement, you may not use the Web App.

Use of the Web App
2.1 The Web App is intended solely for the purpose of learning African languages.
2.2 You may only use the Web App for lawful purposes and in compliance with all applicable laws and regulations.
2.3 You are responsible for providing and maintaining all equipment, software, and internet access necessary to use the Web App.

User Accounts
3.1 In order to access certain features of the Web App, you may be required to create a user account.
3.2 You agree to provide accurate, current, and complete information during the registration process.
3.3 You are solely responsible for maintaining the confidentiality of your account login credentials.
3.4 You are responsible for all activities that occur under your account.
3.5 Provider reserves the right to suspend or terminate your account if any information provided by you is found to be inaccurate, outdated, or incomplete.

Intellectual Property
4.1 The Web App and its content, including but not limited to text, graphics, images, logos, audio, video, and software, are the intellectual property of the Provider or its licensors.
4.2 You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Web App without the prior written consent of the Provider.

Privacy
5.1 Provider’s Privacy Policy governs the collection, use, and disclosure of your personal information by Provider and is hereby incorporated by reference into this Agreement.
5.2 By using the Web App, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

Disclaimer of Warranties
6.1 The Web App is provided on an “as is” and “as available” basis without any warranties, express or implied.
6.2 Provider does not warrant that the Web App will be error-free, uninterrupted, secure, or free from viruses or other harmful components.
6.3 Provider disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability
7.1 Provider, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, arising out of or in connection with your use of the Web App.
7.2 Provider’s liability under this Agreement, whether in contract, tort, or otherwise, shall be limited to the amount paid by you, if any, to Provider for the use of the Web App during the six (6) months preceding the event giving rise to the liability.

Indemnification
8.1 You agree to indemnify, defend, and hold harmless Provider, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs,
expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with your use of the Web App or any violation of this Agreement.

Termination
9.1 Provider may, in its sole discretion, suspend or terminate your access to the Web App for any reason, including but not limited to your breach of this Agreement.
9.2 Upon termination, all provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers of warranty, limitations of liability, and indemnification obligations.

Governing Law and Jurisdiction
10.1 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws principles.
10.2 Any legal action or proceeding arising out of or in connection with this Agreement shall be brought exclusively in the courts of [Jurisdiction], and you consent to the jurisdiction and venue of such courts.

Entire Agreement
11.1 This Agreement constitutes the entire agreement between you and Provider regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and representations, whether oral or written.
11.2 No waiver of any term or provision of this Agreement shall be deemed a further or continuing waiver of such term or provision or any other term or provision.
